Terms of Service

These Terms of Service ("Terms") govern your use of TUA, an AI-powered travel brief platform operated from Australia. By creating an account, generating a brief, or otherwise using TUA, you agree to these Terms. If you do not agree, do not use the service.

1.What TUA is (and is not)

TUA is a research and planning tool. Our AI agents generate travel briefs that compare options and prices compiled from public sources. TUA is not a travel agency. We do not issue tickets, sell inventory, or act as merchant of record for any booking.

When you click "Book", you are redirected to a third-party provider (airline, hotel, tour operator, car hire company, or online travel agent). Your booking contract is with that provider, not with TUA.

2.Accounts

  • You must be at least 16 years old to create an account.
  • You are responsible for keeping your password secure and for activity under your account.
  • You must provide accurate information and update it if it changes.
  • We may suspend or terminate accounts that violate these Terms.

3.AI-generated content — accuracy

Brief content — including flights, hotels, activities, cars, prices, and itineraries — is generated by large language models and is an approximation of real market options. It is not a quote. Availability, prices, schedules, and inclusions can change without notice.

Always verify every detail on the third-party provider's own site before booking or relying on any itinerary. TUA is not responsible for losses, missed connections, incorrect prices, or other issues resulting from inaccurate AI-generated content.

4.Third-party providers

TUA displays information from, and links to, third-party providers (including but not limited to Booking.com, Skyscanner, Viator, Rentalcars, and airline and hotel websites). Their terms, privacy policies, and refund rules apply to anything you book through them. We are not responsible for the acts, omissions, or content of those third parties.

5.Affiliate relationships

TUA may earn an affiliate commission on bookings you complete via the links we provide. This commission does not change the price you pay. Our recommendations are not paid placements.

6.Acceptable use

You agree not to:
  • Scrape, reverse engineer, or programmatically harvest TUA output without written consent.
  • Use TUA for unlawful activity or to generate content that is deceptive, harassing, or harmful.
  • Impersonate another person, create accounts in bulk, or share accounts.
  • Interfere with or disrupt TUA, attempt to bypass security, or overload our infrastructure.
  • Abuse the live GPS feature to stalk, harass, or surveil any person without their informed consent.

7.Group trip features & location sharing

Live GPS sharing within a trip is opt-in per user. You are responsible for ensuring anyone you invite to a trip understands and consents to location sharing before they enable it. TUA provides the tooling; consent is your responsibility.

8.Intellectual property

  • TUA, the TUA brand, logos, design, and platform code are owned by TUA Pty Ltd (once incorporated; operated by the founders until then) or its licensors.
  • You retain ownership of the information you input (trip details, preferences, notes).
  • By using TUA, you grant us a limited licence to process your input to generate and display briefs, and to store them for your account.
  • Brief outputs — the AI-generated text, itineraries, and recommendations — are provided to you for personal travel planning. You may not resell or redistribute brief output as a commercial product.

9.Pricing & paid features

TUA's core brief generation is currently free. We may introduce paid tiers, team plans, or ancillary add-ons (such as travel insurance). If we do, pricing and terms for those will be presented clearly at point of purchase, and these Terms will be updated.

10.Disclaimer of warranties

TUA is provided "as is" and "as available", without warranties of any kind — express, implied, or statutory — to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, secure, or that brief content will be accurate, complete, or suitable for any particular trip.

11.Limitation of liability

To the maximum extent permitted by Australian Consumer Law and other applicable law, TUA, its founders, and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of enjoyment, arising from your use of the service.

Our total aggregate liability to you in any twelve-month period is limited to the amount you paid TUA in that period, or AUD $100 — whichever is greater. Nothing in these Terms excludes or limits any non-excludable consumer guarantees under the Australian Consumer Law.

12.Indemnity

You agree to indemnify TUA against any claim, loss, or expense arising from your breach of these Terms, your misuse of the service, or your violation of a third party's rights (including privacy rights of other trip members).

13.Termination

You may delete your account at any time. We may suspend or terminate accounts that breach these Terms, abuse the service, or put other users at risk. On termination, your account data is deleted in accordance with our Privacy Policy.

14.Changes to these Terms

We may update these Terms from time to time. Material changes will be flagged in-app or by email. Continued use of TUA after changes take effect constitutes acceptance of the updated Terms.

15.Governing law & jurisdiction

These Terms are governed by the laws of Australia. Any dispute arising from these Terms or your use of TUA is subject to the exclusive jurisdiction of the courts of Australia.
